Terms of Use

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and HasData.com (“HasData,” “we,” “us,” or “our”) governing your access to and use of the HasData website, APIs, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Use License

Permission is granted to use the HasData website, APIs, and data delivered through the Services. This is the grant of a license, not a transfer of title. Under this license you may not:

  1. Modify or copy the materials;
  2. Attempt to decompile or reverse engineer any software provided by HasData;
  3. Remove any copyright or other proprietary notations from the materials;
  4. Transfer the materials to another person or “mirror” the materials on any other server;
  5. Resell the data, or resell access to the data through your paid plan, without our written permission;
  6. Republish the data in any form without our written permission;
  7. Register duplicate accounts;
  8. Programmatically access our undocumented APIs.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by HasData at any time. In this event, you will not receive a refund. Upon termination, you must destroy any downloaded materials in your possession whether in electronic or printed format.

2. Account Terms

Access to certain areas of our website and Services is restricted. We reserve the right to restrict access to areas of our website, or the whole website, at our discretion.

If we provide you with an account to enable you to access restricted areas of our website or other content or services, you must ensure that your account credentials are kept confidential. You accept responsibility for all activities that occur under your account.

Enterprise account usage is strictly limited to employees of the organization that has signed up for the enterprise account.

3. Payment and Cancellation

If you elect to sign up for a paid service, you may cancel your account at any time. You accept that if you no longer require the service it is your responsibility to cancel your plan. Cancellation functions are available via your account dashboard.

Refunds are not provided for a change of mind. Your rights for payment of services are protected if your purchase is faulty or does not provide what was promised.

4. Acceptable Use

You must not use the Services or any data obtained through the Services:

(a) In any way that is unlawful, illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity;

(b) In any way that causes, or may cause, damage to the Services or impairment of the availability or accessibility of the Services;

(c) To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services, the servers on which the Services are hosted, or any server, computer, or database connected to the Services;

(d) To compile, collect, or aggregate personal data in violation of any applicable data protection law, including but not limited to the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), or equivalent laws in any jurisdiction;

(e) To make credit, insurance, employment, housing, or other eligibility determinations about any individual, or for any purpose regulated by the Fair Credit Reporting Act (FCRA) or similar laws;

(f) To engage in stalking, harassment, surveillance, or any activity intended to cause harm to an individual;

(g) To train, develop, or improve artificial intelligence or machine learning models in violation of applicable law, including but not limited to requirements under the EU AI Act;

(h) In any manner that you know or reasonably should know violates the terms of service of the website from which the data was retrieved.

You are solely responsible for ensuring that your use of the Services and any data obtained through the Services complies with all applicable laws and regulations in your jurisdiction.

5. Nature of the Services

5.1 Service Description

HasData provides automated web data retrieval and structuring services through its APIs. The Services access publicly available web pages — content that is freely viewable by any user with a standard web browser without requiring authentication, login credentials, or payment — and return structured representations of that content to the User.

5.2 Method of Access

The Services retrieve data from publicly accessible web sources using standard web browsing technologies, including conventional web browsers, HTTP requests, and page rendering methods that are functionally equivalent to the methods used by any individual accessing the same content through a standard web browser. The Services do not bypass, circumvent, or disable any technological measure that controls access to content that is not otherwise publicly available. The Services do not access content that requires authentication, login credentials, or payment to view.

5.3 Publicly Available Data

The data delivered through the Services consists exclusively of content that is made available to the general public by the operators of the source websites. HasData does not access, retrieve, or deliver content that is restricted behind login walls, paywalls, or access controls that prevent the general public from viewing the content. Where a website operator employs rate-limiting or traffic management measures on otherwise publicly available content, such measures regulate the volume and frequency of access, not access itself.

5.4 No Guarantee of Availability

HasData does not guarantee the accuracy, completeness, or timeliness of any data delivered through the Services. Website operators may change, restrict, or remove publicly available content at any time. Data availability may change without notice due to changes in third-party websites or services. HasData is not responsible for changes made by third-party website operators.

5.5 User Responsibility

Users are solely responsible for determining the legality and appropriateness of their use of data obtained through the Services in their jurisdiction and for their intended purpose.

6. Disclaimer of Warranties

The Services and all data delivered through the Services are provided “as is” and “as available” without warranties of any kind, whether express or implied. HasData disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

HasData does not warrant that the Services will be uninterrupted, error-free, or secure, or that any data will be accurate, complete, or current.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall HasData, its owners, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, business interruption, or loss of goodwill, arising out of or related to your use of or inability to use the Services, even if HasData has been advised of the possibility of such damages.

HasData’s total cumulative liability for all claims arising out of or related to these Terms or the Services shall not exceed the greater of (a) five hundred U.S. dollars ($500) or (b) the total amounts you paid to HasData during the twelve (12) months immediately preceding the event giving rise to the claim.

This limitation of liability applies regardless of the legal theory on which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise.

8. Indemnification

You agree to indemnify, defend, and hold harmless HasData, its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

(a) Your use of the Services or any data obtained through the Services;

(b) Your violation of these Terms;

(c) Your violation of any applicable law, regulation, or third-party right;

(d) Any claim by a third party arising from your use of data obtained through the Services, including but not limited to claims of intellectual property infringement, privacy violations, or data protection violations;

(e) Any content or data you transmit through the Services.

This indemnification obligation survives termination of your account and these Terms.

9. Dispute Resolution

9.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Dominican Republic, without regard to its conflict of laws provisions.

9.2 Mandatory Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered by the International Chamber of Commerce (“ICC”) under its Rules of Arbitration then in effect. The arbitration shall be conducted by a single arbitrator in Las Terrenas, Dominican Republic. The language of the arbitration shall be English.

The arbitrator shall have exclusive authority to resolve all disputes arising out of or relating to the interpretation, applicability, enforceability, or formation of these Terms, including whether a claim is subject to arbitration.

Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

9.3 Class Action Waiver

YOU AND HASDATA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class, collective, or representative proceeding.

If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void, and all disputes shall be resolved in court as provided in Section 9.4.

9.4 Exclusive Jurisdiction

For any disputes not subject to arbitration, or if the arbitration provision is found unenforceable, you agree to submit to the exclusive jurisdiction of the courts of the Dominican Republic, located in Las Terrenas, Samana Province, and you waive any objection to venue or jurisdiction in such courts.

9.5 Statute of Limitations

Any claim or cause of action arising out of or related to these Terms or the Services must be filed within one (1) year after the event giving rise to the claim. Failure to file within this period shall constitute a permanent waiver and bar of such claim.

9.6 Attorney’s Fees

In any action or proceeding to enforce these Terms, the prevailing party shall be entitled to recover its reasonable attorneys’ fees and costs.

10. Third-Party Websites and Content

HasData is not affiliated with companies whose logos or trademarks appear on this site. All logos and trademarks remain the property of their respective owners. The use of any logos, trademarks, or service marks is for informational and referential purposes only.

Links to third-party websites and content are not investigated or monitored by HasData. Third-party purchases are exclusively between users and those companies. HasData does not endorse third-party products or services and bears no responsibility for third-party transactions or policies.

11. Revisions

HasData may revise these Terms at any time by posting updated Terms on the website. Material changes will be indicated by updating the “Last Updated” date at the top. Continued use of the Services after any revision constitutes acceptance of the revised Terms.

12. Force Majeure

HasData shall not be liable for any delay or failure to perform any obligation under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, changes in law or regulation, changes to third-party websites or services, internet or telecommunications failures, power outages, or labor disputes.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and HasData regarding the Services, and supersede all prior agreements, understandings, and communications, whether written or oral.
